1. Acceptance of Terms

By downloading, installing, accessing, or using Giftapp ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and the developer of Giftapp ("we," "us," or "our").

2. Description of Service

Giftapp is a mobile application that allows users to:

• Create and manage gift wish lists for events (birthdays, weddings, baby showers, graduations, holidays, and more).
• Organize Secret Santa events with automated random participant assignment.
• Share events via unique codes and QR codes.
• Allow multiple users to contribute toward the cost of a single gift ("gift splitting").
• Import product information (images, titles, prices) from Amazon product links.
• View gift contributors and details in a post-event vault.

The App is a coordination tool only. It does not process payments, handle money transfers, or facilitate any financial transactions. All monetary contributions referenced in the App are for organizational and tracking purposes only. Actual gift purchases and payments are made by users independently, outside of the App.

3. Eligibility

You must be at least 13 years of age to use this App. If you are under 18, you represent that you have obtained the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

• You must create an account to access certain features (e.g., hosting events).
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• Usernames and email addresses must be unique. You may not impersonate another person or use misleading account information.
• You must notify us immediately of any unauthorized use of your account.

5. User Conduct

You agree not to:

• Use the App for any unlawful, fraudulent, or malicious purpose.
• Upload, post, or transmit any content that is offensive, defamatory, obscene, threatening, or otherwise objectionable.
• Attempt to gain unauthorized access to other users' accounts, data, or any part of the App's infrastructure.
• Use automated scripts, bots, or scrapers to interact with the App.
• Interfere with or disrupt the operation of the App or its servers.
• Impersonate another user, person, or entity.
• Use the App to harass, stalk, or harm another individual.
• Circumvent, disable, or otherwise interfere with any security features of the App.

6. Third-Party Content

The App may display third-party content, including but not limited to product information (images, titles, descriptions, prices) fetched from external websites such as Amazon. This content is retrieved from publicly available web pages at the user's request.

• We do not own, endorse, or guarantee the accuracy, completeness, or availability of any third-party content.
• Third-party content is provided "as is" for informational and convenience purposes only.
• Product prices, availability, and information may change without notice and may differ from what is displayed in the App.
• We are not responsible for any purchases you make based on information displayed in the App.
• All trademarks, logos, and brand names displayed are the property of their respective owners.

7. Intellectual Property

All intellectual property rights in the App (including but not limited to design, code, graphics, icons, logos, and text) are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App.
• Reverse-engineer, decompile, or disassemble the App.
• Remove, alter, or obscure any proprietary notices in the App.

8. User-Generated Content

You retain ownership of any content you create or submit through the App (e.g., gift list names, descriptions, messages, participant names). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display such content solely for the purpose of operating and providing the App's services.

You are solely responsible for the content you create. We reserve the right to remove any content that violates these Terms.

9. Gift Splitting & Financial Tracking

The App provides a gift-splitting feature that allows users to indicate how much they intend to contribute toward a gift. Important:

• The App does not process, hold, or transfer any money or payments.
• Contribution amounts displayed are for tracking and coordination purposes only.
• Users are solely responsible for arranging and completing actual payments among themselves.
• We bear no responsibility for disputes, losses, or issues arising from gift contributions or purchases made outside of the App.

10. Secret Santa Events

The Secret Santa feature randomly assigns participants to gift recipients. By participating:

• You acknowledge that assignments are randomized and cannot be guaranteed to meet personal preferences.
• The host is responsible for managing the event and its participants.
• We are not liable for any disputes or issues arising from Secret Santa events.

11. Privacy

Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data. By using the App, you consent to the practices described in the Privacy Policy.

12. Account Termination

• You may delete your account at any time through the Profile section of the App.
• We reserve the right to suspend or terminate your account at any time, without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise inappropriate.
• Upon termination, your right to use the App ceases immediately. Data associated with your account may be deleted permanently.

13. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT DISPLAYED IN THE APP.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

• Your use of or inability to use the App.
• Any unauthorized access to or alteration of your data.
• Any third-party content or conduct on the App.
• Any gifts purchased, contributed to, or exchanged as a result of using the App.
• Any disputes between users regarding gifts, contributions, or events.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR USE OF THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify, defend, and hold harmless Giftapp and its developer(s), affiliates, officers, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any rights of a third party.
• Any content you submit through the App.

16. Modifications to the App & Terms

• We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice.
• We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date.
• Your continued use of the App after any changes constitutes acceptance of the new Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be resolved in the competent courts of that jurisdiction.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding your use of the App, and supersede all prior agreements, understandings, and communications.
